At this webinar, Osler’s Carol Buckmann and Sandra Cohen will discuss how to correct the most common plan mistakes, for U.S. qualified pension and 401(k) plans, as well as non-qualified plans, including the following:

  • When you can self-correct violations
  • Performing a self-audit – catching mistakes before the IRS does
  • The IRS plan qualification correction program (EPCRS)
  • 5500 Problems (Delinquent Filer Program)
  • The Voluntary Fiduciary Correction Program
  • Section 409A corrections for non-qualified deferred compensation
  • Other agency penalty policies and programs
  • What to do when you get a penalty notice.

U.S. benefit law seems to become more complicated every year. One result is that even diligent plan sponsors may not be in full compliance. Using formal and informal correction programs can result in lower penalties, but your plan will be eligible to use them only if you find the problem before government auditors do. This program will provide an overview of available Internal Revenue Service, Department of Labor and Pension Benefit Guaranty Corporation correction programs and penalty policies.  The speakers will also suggest good compliance practices.
