Osler is pleased to announce that our Intellectual Property Group has once again earned the silver band ranking in both the Firms and Firms: anti-counterfeiting categories by the World Trademark Review 1000: The World’s Leading Trademark Professionals 2018 (the WTR 1000). Five of our lawyers also earned special recognition in four categories for their legal expertise and exceptional client service in various areas of trademark practice.

Osler was one of only four firms to be recognized in both the Firms and Firms: anti-counterfeiting categories. The WTR 1000 identified Osler’s commitment to client service as one of the reasons for its silver band ranking, which recognizes practices and individuals “renowned for their top-end work.” Osler’s “success lies in its unwavering commitment to client service: enquiries are replied to instantly, a premium is placed on face-to-face contact and monetization opportunities are pragmatically presented,” according to the WTR 1000 website. The website also praised Osler’s “ample experience” acting at every level of court in Canada.

Five of our lawyers also earned eight individual rankings across four categories:

  • Donna White and Lee Webster — gold band in prosecution and strategy
  • John Cotter and May Cheng — silver band in both anti-counterfeiting and enforcement and litigation
  • Kelly Moffatt — silver band in prosecution and strategy and recognized in transactions category

Donna, Managing Partner of Osler’s Ottawa office, was commended by the WTR 1000 editors as “tremendous” and “incredibly responsive.” Donna’s “impeccable work reflects a thorough knowledge of Canadian trademark law” and she’s a “go-to practitioner for complicated registration or enforcement matters.” Her practice focuses on trademark prosecution with a significant emphasis on proceedings before the Trademark Opposition Board.

Lee was recognized as a founding member of the Canadian Intellectual Property Council and lauded by the WTR 1000 for his “licensing expertise with complex contractual work” for various clients. His practice encompasses a full range of intellectual property services including counseling, acquisition, clearance and infringement opinions, enforcement, commercial and litigation support and intellectual property portfolio strategies.

John was praised for being a “top-draw litigator and anti-counterfeiting expert, not to mention a true gentleman.” He has extensive experience in disputes relating to copyright, trademarks, domain names, trade secrets/confidential information, counterfeit products, misleading advertising, software licensing and IT projects, including disputes arising out of software development and software integration projects.

May has more than 20 years of experience advising clients on all aspects of intellectual property protection and enforcement, including branding strategy, licensing and anti-counterfeiting. She was recognized by WTR 1000 as having “superb trademark knowledge and a strong reputation.”

Kelly was lauded by the WTR 1000 as “outstanding” and exhibiting “a robust understanding of the law and excellent strategic skills.” She was also recognized for guiding matters through “quickly, smoothly and efficiently.” Kelly’s commercial practice has an emphasis on consumer protection, marketing, distribution and intellectual property matters.

The WTR 1000 “shines a spotlight on the firms and individuals that are deemed outstanding in this critical” trademark practice area. Recognitions are based on months of extensive in-person and telephone interviews as well as client and peer feedback. Firms are recognized based on the depth of their expertise, market presence and the level of work on which they are typically instructed.

Osler’s Intellectual Property Group is renowned for its diverse strengths, including excellence in IP litigation; expertise and innovation in patent and trademark prosecution; portfolio advising and management; and unmatched experience in helping realize the value of IP portfolios in mergers, reorganizations and other business transactions.
