Data Litigation Roundtable
In this month’s webinar, Adam Kardash will be joined by Chris Naudie, Kristian Brabander, Tommy Gelbman, and Jessica Harding, Partners from Osler’s national privacy and data litigation team.
The semi-annual Data Litigation Roundtable will focus on key themes and takeaways from recent decisions across Canada, as highlighted in the Third Edition of Osler’s Privacy Jurisprudence Review (Fall 2024).
Among other topics, the discussion will cover:
- The assertion of privilege over forensic reports and other internal documents created in response to a data breach (LifeLabs v. Ontario IPC);
- The Federal Court’s latest decision about the concept of “commercial activities” when considering the applicability of PIPEDA (Parker v. Ontario Medical Association);
- Recent developments in data breach and data misuse class actions, including:
- judicial consideration of biometric data,
- causes of action that are successfully being certified, and
- the assessment of class-wide damages.
