The mandatory security breach notification regime under Personal Information Protection and Electronic Documents Act (PIPEDA) comes into effect on November 1st. These new rules will have a significant impact on private sector organizations across all sectors.

This session will provide an overview of key elements of PIPEDA’s security breach notification requirements, including:
- the meaning of “real risk of significant harm” – the legal trigger for reporting security incidents to the Office of the Privacy Commissioner of Canada, and notifying affected individuals and other organizations;
- the timing and content requirements for reporting and notification;
- the obligations for direct and indirect notification to affected individuals; and
- record keeping requirements.
The session will include a discussion of the broad impact of the new breach notification regime, and a snapshot of the practical steps organizations are taking to prepare and respond to security incidents.
