The Commission d'accès à l'information (CAI) has prepared draft guidelines on the criteria for the validity of consent under Law 25's amendments to Quebec’s private and public sector privacy legislation. The CAI is holding a six-week consultation, ending on June 25, 2023, to seek stakeholder feedback on the text of these guidelines. 

The draft guidelines contain detailed commentary on how to comply with the consent and related requirements under Quebec's private and public sector privacy legislation. As of September 22, 2023, failure to comply with these and other requirements will expose organizations to potentially severe financial penalties, up to $25 million or 4% of worldwide turnover.
