International trade developments pose challenges, provide opportunities for Canadian companies

Canadian companies that engage in cross-border trade and investments in the United States and internationally should be mindful of the changing trade environment that could have a profound impact on their business strategies. These changes include the Canada-United States-Mexico Agreement (CUSMA), the Canada-European Union Comprehensive Economic and Trade Agreement (CETA) and the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP).

Perhaps most notably, after a lengthy negotiation process, Canada, the United States and Mexico reached a new trilateral trade deal — the CUSMA — that will have a widespread impact on a broad range of industries ranging from the auto sector to the agricultural sector. Canadian companies must now be ready to integrate changes to the rules into their business strategies to remain competitive and stay compliant.

Another key cross-border trade initiative that Canadian businesses need to be cognizant of is CETA, which came into force in 2017. CETA not only reduces and ultimately eliminates tariffs between Canada and the EU, but also opens up vast new opportunities for Canadian businesses in the EU government procurement sector.

Canada announces expanded, sector-specific sanctions on Belarus

On August 9, 2021, Canada announced expanded sanctions on Belarus, imposing sector-specific restrictions on activities relating to transferrable securities and money market instruments, debt financing with longer than 90 days’ maturity, insurance and reinsurance, petroleum products and potassium chloride products. These expanded sanctions are a marked change from Canada’s most recent approach to its Belarusian sanctions, which, until the recent amendment, were limited to restrictions on dealings with listed individuals and entities.
