Josh represents organizations in corporate and commercial disputes, with a particular focus on manufacturer’s liability, faulty products, class actions and construction litigation. Josh also provides advice with respect to municipal issues, tendering, procurement and regulatory and internal investigations in both the public and private sectors. He has represented clients in a wide variety of disputes involving construction liens, recovery of debts, contract interpretation, delay and extras claims, professional negligence and claims under performance and payment bonds, as well as project-specific insurance policies.

Prior to joining the firm, Josh held positions with the B.C. public service and acted as a teaching assistant in administrative law at the University of Victoria, School of Public Administration. Josh joined Osler as a summer student in 2010 and began as an Associate with the firm in 2012.

    • Maple Leaf Foods in litigation, insurance and construction lien matters relating to the design and construction of a $400 million production facility.
    • Toronto Transit Commission in design and construction disputes and construction lien proceedings in respect of a major subway station and transit line project.
    • Irving Oil in the context of a civil liability class action stemming from a derailment in Lac-Mégantic, Quebec.
    • A Canadian Auto Manufacturer in a class action brought on behalf of former employees involving post-retirement benefits.
    • A Household Products Manufacturer in manufacturer’s liability and faulty products actions.
    • A Major Public Organization in conducting an internal investigation and providing advice and strategic recommendations for procurement operations.
    • The City of Kingston in litigation relating to remediation of municipal parking garages.
    • A Major Municipality with respect to potential challenges to a development charges by-law.
    • Ivaco Rolling Mills in litigation and construction lien disputes with respect to the transformation of a steel production plant.
    • Maple Leaf Foods in litigation and insurance disputes relating to the design and construction of a major distribution centre.
    • A Major Software Company in a contractual dispute relating to claims of fundamental breach and negligent misrepresentation.
