Nathan practices corporate and commercial litigation with a primary focus on energy litigation. Nathan’s experience includes complex contractual disputes arising from M&A transactions, joint ventures, shareholder agreements, and other commercial arrangements. Nathan has also acted in litigation surrounding major resource projects, including judicial review applications.

Nathan has acted for clients before the Court of Queen’s Bench of Alberta, the Court of Appeal of Alberta, and the Federal Court of Appeal.

    • Kinder Morgan Canada Limited in its litigation victories for the Trans Mountain Pipeline Expansion.
    • Murphy Oil in respect of a judicial review and statutory appeal of decisions taken by the Newfoundland and Labrador Minister of Finance under the Offshore Area Corporate Income Tax Acts.
    • Shawcor in a multi-party dispute against Paramount in respect of a failure of a buried pipeline that resulted in the discharge of produced water.
    • CNRL in multi-billion-dollar litigation associated with the Horizon Oil Sands operation.
    • ConocoPhillips, Equinor, Anadarko, et al in several multi-million dollar disputes with Geophysical Service Incorporated over seismic data use and fees.
    • Canexus in a dispute with Superior Plus Corporation over a $25 million break-fee provision.
    • TAQA in a complex contractual claim involving alleged breaches of various post-closing conditions arising from a $95 million purchase and sale transaction.
    • Corus Radio in its successful injunction motion over station-naming
