Overview

Through instruction by demonstration complemented by interactive panel discussions, this mini-cartel workshop will take participants through the lifecycle of an international cartel – from its formation, to detection and dawn raids, to applying for immunity or leniency under the Competition Bureau’s immunity and leniency programs.

Participants will:

  • watch the formation of a cartel and its eventual detection by internal counsel
  • participate in a live board of directors emergency meeting to discuss with counsel the consequences of cartel conduct and strategize on managing the legal risk
  • witness the execution of a dawn raid
  • observe the operation of the Bureau’s immunity and leniency programs

Through a series of scenarios, and specifically from the perspective of company management and internal counsel, participants will explore the numerous factors to be taken into account in determining whether a company should apply for immunity or leniency in Canada, a decision that must be made quickly and a process that is complex, time-consuming and resource-intensive.

The workshop will be led by members of Osler's Competition and Antitrust team, as well as the following special guests:

  • Martin Guest, Senior Vice-President, General Counsel Canada at Manulife Financial
  • Graham Reynolds QC, Senior Counsel, Regulatory & Internal Investigations HUB, TD Bank Group

Continuing Professional Development:
Ontario: This program contains 1 hour 30 minutes Professionalism and up to 1 hour, 45 minutes Substantive for a total of 3.25 CPD hours.
Quebec: This program has been approved for 3.25 credit hours in accordance with the requirements for “out of province” activities. Certificates will be made available after the seminar.
