Through reflection, interactive discussion, and thought provoking content, participants will come to understand in a profoundly different way the decision that is leadership and the obligation that it brings. Ethics in Negotiation

December 5
12:30 to 2:00 p.m.
Osler’s Toronto office or via webinar

As lawyers and advocates, we negotiate every day of our practice, sometimes not even realizing it. In this session, we will explore the role of ethics in negotiations. We will cover areas such as:

  • What is the role of ethics in negotiation?
  • What guidance is given in the Rules of Professional Conduct when it comes to behaving ethically?
  • How do concepts of trust, morality and ethics fit together? Is “not saying anything” the same as lying?
  • How does having a reputation for “doing the right thing” impact your ability to negotiate successfully?
  • Can you still be ethical if your client is not?

Randal Graham, professor of legal ethics at the University of Western Ontario, will set out a framework for discussion of these important topics and will further examine the topic using sample fact scenarios.
