Overview
Derivatives regulatory reform continues to gather steam in Canada and Osler’s derivatives group is dedicated to keeping you in the know on the latest announcements. On August 25th, participating jurisdictions (Ontario, British Columbia, Saskatchewan, New Brunswick, Prince Edward Island and Yukon) announced the publication for comment of a revised Capital Markets Act (CMA) and regulations that will replace existing securities and derivatives regulation in each participating jurisdiction. The new proposal is part of the planned transition by participating jurisdictions to a Cooperative Capital Markets Regulatory System (CCMRS). Among other changes, the implementation of the CMA and CCMRS regulations will result in the introduction of a registration and prospectus exemption for trading OTC derivatives in Ontario and the repeal of the Commodity Futures Act (Ontario).
