On November 9, 2024, the Canadian government published draft regulations aimed at capping greenhouse gas emissions from the oil and gas sector through a cap-and-trade system. The primary objective of the proposed policy is to require producers in the sector to reduce emissions by 35% below 2019 levels by 2030.
In a recent episode of the ARC Energy Ideas podcast, a regular program that explores trends that influence the energy business and is produced by ARC Energy Research Institute, Sander Duncanson, Osler partner and Co-Chair of the firm’s national Regulatory, Indigenous and Environmental practice, joined hosts Jackie Forrest and Peter Tertzakian to discuss these proposed regulations and the challenges they pose to the sector.
During the podcast, Sander draws on his extensive experience to share his insights into the substance of the proposed policy and the impacts it could potentially have, both intended and unintended. He also weighs in on the likelihood of the regulation actually becoming law and the process that would be required to repeal the legislation in the event of a change in federal government. Finally, Sander discusses the possibility of the Alberta government challenging the constitutionality of the regulations, suggesting the policy might be on constitutional “shaky ground.”
