Osler has been retained by the City of Toronto, the owner of Union Station, to advise and represent the City in multiple complex construction litigation matters resulting from several multi-year projects relating to the revitalization and enhancement of Union Station. These projects comprise a $665 million, multi-year, multi-phase revitalization of the facility, which is maintaining full operation throughout construction.
The litigation surrounding the Union Station Revitalization Project includes disputes relating to the consulting services agreement with the designer, NORR, delay and deficiencies claims with the original general contractor, Carillion Construction Inc., including a large number of construction lien and labour and material payment bond claims that arose in the context of the bankruptcy of Carillion. The disputes have continued with the replacement general contractor, Bondfield, and – following its bankruptcy – with its surety, Zurich. The Carillion litigation represented one of the most complex construction litigation matters in Canada, and was successfully settled by crafting a creative dispute-resolution process involving preliminary, Executive Discoveries, pre-exchange of key documents, and the largest mediation ever held by Canada's top mediator, George Adams, involving 120 lawyers, experts and clients.
Toronto’s Union Station is the busiest passenger transportation hub in Canada, and involves multimodal intercity rail, subway, bus and streetcar services.
