Emma is an associate in both the Financial Services Group and Restructuring and Insolvency Group of our Vancouver office. Her practice focuses on commercial lending, assisting financial institutions, private lenders and borrowers with negotiating, and preparing financial agreements and associated loan documentation.
Emma also advises companies in need of restructuring, as well as trustees, receivers, financial institutions, commercial lenders, noteholders and other creditors throughout insolvency proceedings. She has experience in a wide range of insolvency matters and has acted for court officers, companies and creditors in Companies’ Creditors Arrangement Act and Bankruptcy and Insolvency Act proceedings as well as both court- and privately-appointed receiverships.
Representative Work
- British Columbia v. Peakhill Capital Inc., 2024 BCCA 246, counsel to the second-secured creditor, obtaining the first reverse vesting order in a receivership in British Columbia, resulting in over 3 million dollars in tax savings, with approval of both the Supreme Court of British Columbia and the Court of Appeal for British Columbia.
