Mark has a wide-ranging corporate-commercial litigation practice, with expertise in complex contractual disputes, class actions, tax litigation, complex financial matters, and insolvencies.
Mark is committed to client service, identifying and obtaining practical results that meet his clients’ objectives, whether in the courtroom or the boardroom. He is a co-leader of Osler’s case assessment team, which specializes in analyzing and valuing complex disputes. He has appeared before courts across Canada, including the Ontario Superior Court of Justice (Commercial List), Court of Appeal for Ontario, Tax Court of Canada, Federal Court of Appeal and Supreme Court of Canada.
Representative Work
- Represented Hino Motors, Ltd. in a class action related to alleged emissions issues.
- Represented Economical Mutual Insurance Company in one of the few common issue trials in Canada. Case claimed for business interruption insurance coverage arising from the COVID pandemic. Case dismissed at trial, upheld on appeal.
- Represented the senior secured lenders in receivership proceedings against the developer of “The One” condominium project.
- Represented Economical Mutual Insurance Company in a trial related to entitlement to benefits from Economical’s demutualization.
- Represented Fiera Foods International in the precedent setting trial on an input tax credit dispute related to the use of employment agencies.
- Represented Cameco Corporation in the precedent-setting trial of a transfer pricing dispute in the Tax Court of Canada relating to Cameco’s international sales structure, and the subsequent appeal to the Federal Court of Appeal.
- Represented Loblaws Companies Limited in the precedent-setting trial of a tax dispute in the Tax Court of Canada relating to Loblaw’s international financial affiliate, and the subsequent successful appeal to the Federal Court of Appeal.
- Represented Cameco Corporation in the precedent-setting trial of a transfer pricing dispute in the Tax Court of Canada relating to Cameco’s international sales structure, and the subsequent appeal to the Federal Court of Appeal.
