Scott is a member of Osler’s Regulatory, Indigenous and Environmental practice. Scott’s practice focuses on project-related natural resource development, environmental law and energy regulation, as well as administrative and Indigenous law issues. He acts for a variety of companies in regulatory proceedings to obtain approvals for major projects in the wind, solar, battery storage, electricity transmission, pipeline, carbon capture and storage, and oil and gas sectors.
Scott provides strategic advice across the full lifecycle of major electricity generation and natural resource projects. He advises clients on matters related to project planning and siting, environmental assessments, stakeholder consultation and negotiations, continuing regulatory compliance, and decommissioning and reclamation. He also regularly assists clients with natural resource and environmental sector commercial transactions, regulatory investigations, environmental enforcement actions, contaminated site liability issues and environmental, social and governance (ESG) matters.
Scott has assisted clients with matters before the Canada Energy Regulator, the Alberta Utilities Commission, the Alberta Energy Regulator, the Alberta Land and Property Rights Tribunal, the British Columbia Utilities Commission, the British Columbia Energy Regulator and all levels of court in Manitoba. He has successfully represented clients in some of the largest and most high-profile energy developments in Western Canada.
Before practicing law, Scott was an archaeologist working throughout Manitoba. He has on the ground experience related to electricity generation, natural resource development and environmental impacts.
Representative Work
- Universal Kraft Canada Renewables (a joint venture between Korkia and Universal Kraft) in its applications to the Alberta Utilities Commission to construct and operate the 268.4 MW Oyen I Solar Project and 162 MW Oyen II Solar Project. This was the first proceeding where separate non-co-located renewable power plant applications were considered in a single hearing process.
Prior to Joining Osler:
- Representing a consortium of renewable generation companies, with regard to providing legal and regulatory advice in response to the Alberta Utilities Commission inquiry into the ongoing economic, orderly and efficient development of electricity generation in Alberta and related policy direction from the Government of Alberta.
- Representing various renewable energy developers with respect to applications to the Alberta Utilities Commission, including:
- Applications to construct and operate the 450 MW Aira Solar Project, which is one of the largest approved solar energy projects in Canada
- Amendment applications to construct and operate the 514.6 MW Buffalo Plains Wind Farm project, along with applications to construct and operate the associated transmission infrastructure
- Applications to construct and operate the 196 MW Willow Ridge Wind Project, including the 100 MW battery energy storage system
- Amendment applications to construct and operate the 192 MW Wild Rose 2 Wind Project
- Applications to construct and operate the co-located 17 MW Lethbridge 2 Solar Project and 140 MW Lethbridge 3 Solar Project.
- Advising clients in connection with regulatory compliance and litigation involving contaminated sites, including responding to contaminant releases and communicating with applicable regulators
- Acting for companies charged with violations of environmental statutes
- Advising on regulatory and environmental issues associated with purchases, sales, initial public offerings, mergers and acquisitions of various companies
- Representing a pipeline company regarding various land rights acquisition and utility crossing proceedings before the Canada Energy Regulator
