Simone is a litigator in our Vancouver office. Simone has a diverse practice with a focus on commercial and corporate disputes, and class action defence.
Simone enjoys unpacking complex legal issues and has acted on a range of matters relating to contracts, company and partnership disputes, professional liability and property law.
Simone has appeared and made submissions before all levels of court in British Columbia. Prior to joining Osler, Simone articled and practiced at a litigation boutique in Vancouver.
Representative Work
Prior to joining Osler:
- Advising on and defending against consumer protection class actions against pharmaceutical and natural health products companies.
- Advising and acting for regulated professionals defending negligence claims and regulatory complaints.
- Advising and acting on partnership and other disputes in connection with real estate development.
- Successfully defended a claim for termination of a sublease for fundamental breach on summary trial and on subsequent appeal.
- Successfully defended against an application to strike and dismiss a claim for violating the rule against maintenance and champerty following an assignment of the claim to a third party.
- Successfully defended on summary trial a claim against a law firm acting as trustee under the Real Estate Development Marketing Act.
- Successfully applied for declaration of contempt of court against defendants in breach of interim injunction order enforcing a restrictive covenant under a franchise agreement.
