Toronto’s local public transportation agency, Toronto Transit Commission (“TTC”), oversees the Toronto-York Spadina Subway Extension Project (the “Project”), which is an 8.6 kilometre extension of the existing TTC subway system, including new subway stations and tunnels.

TTC contracted with OHL Construction Canada and Fomento De Construcciones Y Contratas Canada Limited Partnership (“OHL/FCC”) to, among other things, excavate certain sections of the new subway tunnels, and to construct one of the subway stations forming part of the Project.

OHL/FCC brought an action against TTC for, among other things, breach of contract, negligence and unjust enrichment, and Osler acts as counsel to TTC in defending this action.
